Experience

Obtained complete dismissal with prejudice of all claims in a class action asserting claims under the federal and California state wiretapping statutes. Plaintiff alleged that the client violated wiretapping laws when the text messaging platform unlawfully “intercepted” confidential communications sent by individuals to the client’s celebrity clients. The Ninth Circuit affirmed the decision.

Defended client and its affiliates in five separate privacy class actions related to two popular dating apps. The litigation chiefly asserted claims under Illinois’s Biometric Information Privacy Act (BIPA).

Defending client in a class action asserting RICO, fraud, and a range of state law claims alleging that the client improperly obtained rate increases for its services.

Representing client in a putative class action involving allegations that defendant developed and released generative AI systems that allegedly violate copyright laws.

Represented a cloud-based software company in a putative class action filed under the California Consumer Privacy Act, alleging that the company was responsible for a data security incident on its e-commerce platform that resulted in the improper disclosure of consumers’ personal information.

Representing technology company in consumer class actions pending in courts around the country, challenging, among other things, recruitment practices, cancellation fees, and sending texts to consumers. In one of these matters, achieved a ruling in favor of defendant after a bench trial.

Represented a consumer electronics manufacturer in class action involving alleged violations of the Wiretap Act and unfair competition claims. Defeated class certification and achieved summary judgment in favor of defendant, which was affirmed by the Ninth Circuit.
