Dave McGowan brings a diverse array of experience to Morrison Foerster—ranging from antitrust and intellectual property litigation to representation of lawyers in risk management and professional liability matters.
Dave's practice focuses on economic issues in IP and antitrust cases and on representation of lawyers. Dave counsels law firms in risk management decision-making and represents them in litigation. He represented Genentech and City of Hope in multiple suits concerning the Cabilly patent family, and frequently advises clients on IP licensing issues.
Dave is the current Lyle L. Jones Professor of Competition and Innovation Law at the University of San Diego School of Law. He is the author of Developing Judgment About Practicing Law, an ethics casebook published by West. Dave is a member of the American Law Institute.
(Northern District of California). Represented plaintiff class members in antitrust class action pertaining to HIV drugs through successful class certification.
(District of Delaware) Represented defendant in patent infringement suit resulting in a defense verdict after jury trial.
(Confidential Arbitration, ICDR). Represented selling shareholder representative against the acquiror for wrongful withholding of substantial escrow; recovered entire amount sought.
