Jamie Levitt, J. Alexander Lawrence, Claire Abrahamson, and Aditya Kamdar were featured in Law360’s Legal Lions of the Week column for their work in helping a pregnant Texas woman secure the right to have an abortion under an exception to the state’s abortion ban after her fetus was diagnosed with trisomy 18, a fatal fetal anomaly, and several trips to the emergency room. This is believed to be the first attempt in the nation to seek a court-approved abortion since the U.S. Supreme Court overturned Roe v. Wade in 2022.
Judge Maya Guerra Gamble of Travis County District Court granted a temporary restraining order allowing Kate Cox to have an abortion and protecting her husband and doctor from civil and criminal penalties in connection with the abortion. The judge agreed with Cox’s doctors that the procedure was medically necessary to prevent Cox from a dangerous birth and to preserve her future fertility. The authorization from the District Court was stayed when the Texas Attorney General appealed to the Texas Supreme Court.
