The European Union (EU) has enacted laws and/or issued guidance on Artificial Intelligence (AI). Companies subject to EU laws and regulations should be familiar with all relevant AI-related laws, regulations, and guidance, including those listed below.

General

The AI Act establishes harmonized rules for placing on the market, putting into service, and using artificial intelligence systems (“AI Systems”) in the European Union. It prohibits certain AI practices and establishes:

  • specific requirements for high-risk AI Systems and obligations for operators of such systems;
  • harmonized transparency rules for certain AI Systems;
  • harmonized rules for placing on the market of general-purpose AI Systems;
  • rules on market monitoring, market surveillance governance and enforcement; and
  • measures to support innovation, with a particular focus on SMEs, including start-ups.

Principles, Studies, & Recommendations

General

The Report provides an overview of standards related to cybersecurity of AI and an assessment of their coverage and gaps in standardization. It also examines how standardization can support the implementation of the cybersecurity aspects embedded in the EU AI Act and issues recommendations for organizations on standardization in support of cybersecure AI.

The report addresses the practical effects of AI-based algorithms on people and reviews the use of AI in predictive policing and offensive speech detection. It sets out recommendations for implementing more comprehensive and thorough assessments of algorithms to combat bias.

The Declaration promotes a set of principles and values to guide policy makers and digital operators.

The EDPB Opinion considers: when and how AI models can be considered anonymous; whether and how legitimate interest can be used as a legal basis for developing or using AI models; and what happens if an AI model is developed using personal data that was processed unlawfully.
