WASHINGTON, D.C. (January 14, 2025) – Morrison Foerster and Lawfare just released the latest episode of The Regulators podcast featuring the Chief of DOJ’s Counterintelligence and Export Control Section, Jennifer Kennedy Gellie. Chief Gellie, who oversees FARA enforcement, discussed DOJ’s proposed changes to the Foreign Agents Registration Act (FARA) regulations.
For the first time in 30 years, DOJ is seeking to materially revise FARA. The changes mark a significant shift in DOJ’s approach to its enforcement and interpretation of FARA to include narrowing the exemption for commercial activities. If adopted, the revisions will significantly expand the scope of activities and entities subject to FARA’s registration requirements and impose greater compliance costs on registrants.
