Megan Gerking Recognized in Global Competition Review’s 40 Under 40 List
Washington, D.C. partner Megan Gerking has been named in Global Competition Review’s 40 Under 40 list. The list aims to identify the next generation of the world’s top antitrust lawyers by surveying law firms, economic consultancies, enforcement agencies, academic institutions, and companies.
Megan, a former U.S. Department of Justice (DOJ) Antitrust Division trial attorney, is a partner in Morrison Foerster’s Global Antitrust Law practice, specializing in government-facing antitrust matters. She represents companies in criminal and civil conduct investigations before the DOJ Antitrust Division, Federal Trade Commission (FTC), and state enforcers and in all phases of the merger review process before U.S. and foreign competition authorities. In recent years, she has also developed a niche counseling practice focusing on the intersection of antitrust and environmental, social, and governance (ESG) standards.
While serving in the Antitrust Division, Megan investigated and prosecuted federal antitrust violations and international cartel cases. For her work investigating and prosecuting international price fixing, bid rigging, and market allocation conspiracies by automotive parts suppliers, Megan earned the Assistant Attorney General’s Award for Distinguished Service. She was also awarded the DOJ’s Outstanding Mentor Award by the Attorney General.
In private practice, Megan has achieved significant results for her clients in government-facing investigations and when navigating clients through the merger clearance process. Some of her recent highlights include representing a critical witness in the United States v. Patel criminal no-poach prosecution brought by the DOJ Antitrust Division, obtaining non-prosecution protection for two healthcare companies in separate DOJ Antitrust Division criminal investigations, and defending Glenmark Pharmaceuticals in a federal antitrust multidistrict litigation alleging price fixing and market allocation of dozens of drugs by major generics manufacturers. Megan has also successfully handled internal antitrust investigations of large publicly traded companies and avoided scrutiny of the DOJ and other regulators. As part of her merger practice, Megan notably navigated ShowingTime through an extended review by the FTC of its $500 million vertical acquisition by Zillow Group.
