Ruti Smithline spoke to ALM International about the civil liability verdict against Chiquita Brands International (“Chiquita”) and key takeaways from the trial about compliance work in Latin America. Chiquita was found liable for murders committed by terrorist group United Self-Defense Forces of Colombia (AUC) that the banana grower had paid protection fees to in Colombia.
The case raised significant considerations for corporate attorneys who advise U.S. companies that do business in Latin America. Ruti noted that in these situations compliant companies find ways to be compliant.
“One takeaway from the trial is for companies to strengthen their internal compliance programs so they can mount a better defense when problems arise,” Ruti said.
