Gallo, Montucky and More: The Big Picture

David Cross was featured in Beer Business Daily’s coverage of Provi’s antitrust suit against Southern Glazer’s Wine and Spirits and Republic National Distributing Company. U.S. District Judge Nancy Maldonado recently told the parties that she is denying the defendants’ motion to dismiss and that it’s time to “get going” with discovery.

David, representing Provi, told Judge Maldonado that “we’re kind of not anywhere” on discovery and that Provi believes initial disclosures from Southern and RNDC are insufficient, as “only a few people at the companies have been identified as ‘relevant individuals’” for discovery purposes. Judge Maldonado directed the parties to submit a case schedule with trial as early as next year.
