Carrie Cohen and Nathan Reilly wrote a piece for Law360’s Expert Analysis column that explored the expansive nature of the New York attorney general's authority under the Martin Act and Section 63(12).
The pair wrote, “Central to the efficacy of the Martin Act and Section 63(12) is that they grant the New York Attorney General's Office wide discretion to commence investigations and exercise its authority after passing a relatively low threshold of possessing a good-faith belief that the law has been violated and that any requested information will be relevant and material to its investigation.”
Carrie and Nathan concluded that the “flexibility of these virtually one-size-fits-all statutes has allowed the New York attorney general to remain at the forefront of regulatory activity in new and emerging industries.”
