Trends in Non-Compete Litigation and Enforcement

Bonnie Lau, Margaret Webb, and Anissa Chitour published an article in Competition Journal that discussed the Federal Trade Commission's (FTC) recent national non-compete agreement ban, which has since been challenged in litigation by industry organizations.

The authors shared insights on the potential effects of the FTC's non-compete ban and the litigation challenging the ban, recommending "a comprehensive review of potentially covered agreements" and "continued monitoring of the ongoing litigation challenging the FTC’s final rule and how its enforcement and applicability will shift following the courts’ ultimate determinations."
