On Thursday, March 23, 2023, Morrison Foerster’s San Diego office is hosting the San Diego IP Law Association (SDIPLA) program “Antibody Patents in a Bind? Evolving Case Law and Practical Strategies.” MoFo’s Karen Potter, Ph.D., and Meghan Poon, Ph.D., will lead this discussion on the landscape for antibody therapeutics patent protection. Antibody therapeutics represent a growing share of FDA approved drugs and are some of the most effective and highest-grossing drugs on the market today. However, obtaining meaningful IP protection for antibodies has become increasingly challenging over the course of the last decade. Recent cases, including Amgen v. Sanofi, which is being heard at the Supreme Court this term, have invalidated antibody patents on the basis of lack of enablement and/or written description leading antibody innovators to wonder how best to protect their inventions in view of these prevailing headwinds. During this presentation, we will discuss the impact of these recent court decisions and strategies for drafting and prosecuting antibody patent applications to obtain meaningful protection. We will also look to the future and consider the potential impact of the Supreme Court’s decision as well as how evolving antibody technology may affect the IP landscape.
