Partner Beth S. Brinkmann today argued before the U.S. Supreme Court in Rowe v. New Hampshire Motor Transport Ass’n, No. 06-989. Morrison & Foerster represents three trade associations—the New Hampshire Motor Transport Association, the Massachusetts Motor Transportation Association, and the Vermont Truck & Bus Association—in a dispute over whether the Federal Aviation Administration Authorization Act of 1994 preempts a Maine law that regulates the manner in which commercial carriers must deliver packages. The argument was Ms. Brinkmann’s 23rd oral argument before the Supreme Court.
This argument was the fifth oral argument by a Morrison & Foerster attorney in 2007. Ms. Brinkmann previously argued on behalf of Mattel, Inc., in Hall Street Associates, L.L.C. v. Mattel, Inc., No. 06-989, in the beginning of November and on behalf of the Governor of Guam in Limtiaco v. Camacho, No. 06-116 in January. Of counsel and former Solicitor General of the United States Drew S. Days, III, argued on behalf of Klein & Co. Futures, Inc., in Klein & Co. Futures, Inc. v. Board of Trade of the City of New York, No. 06-1265, in October, and of counsel Seth M. Galanter argued on behalf of two civil rights plaintiffs in Sole v. Wyner, 06-531, in April.
