Mr. Celniker has extensive international commercial litigation and arbitration experience, with particular emphasis on multi-jurisdictional disputes and intellectual property issues.
Mr. Celniker has represented both international and domestic companies in the litigation and arbitration of patent, trademark, copyright, trade secret, contract and other business disputes in a variety of industries before state and federal courts, the International Trade Commission, Trademark Trial and Appeal Board, and several prominent international arbitration organizations, including the American Arbitration Association, International Chamber of Commerce, London Court of International Arbitration, Japanese Commercial Arbitration Association and others. Mr. Celniker’s experience also includes participation in a variety of international or cross border litigation issues. On the transactional side, he has negotiated development, licensing, manufacturing and supply agreements in the medical, pharmaceutical, electronics and computer industries.
Mr. Celniker was admitted to practice in New York in 1991 and California in 1998. He is a member of the American Bar Association and of the Dai-ni Tokyo Bar Association
Representative Matters
- Currently represent an Indian software development company in a multimillion dollar breach of contract arbitration for customizable insurance software before the Japan Commercial Arbitration Association.
- Currently represent a major Japanese conglomerate in a multimillion dollar breach of contract case arising out of a construction consortium in Brazil before the ICC in Zurich.
- Successfully represented large Italian pharmaceutical company in a breach of contract and patent infringement arbitration before the ICC in Paris.
- Successfully defended Echostar Communications Corp in a patent infringement case initiated in the ITC by Gemstar Corporation.
- Obtained US$ 12 million verdict on behalf of Syntron Bioresearch Inc. in misappropriation of trade secrets case involving technology for diagnostic test kits.
