Jill Neiman's practice emphasizes intellectual property litigation and counseling, particularly patent matters.
Ms. Neiman graduated magna cum laude from Yale University in 1984, with distinction in her major, biology. She received her law degree in 1991 from the University of Michigan, where she was elected to Order of the Coif and was a member of the Michigan Law Review. From 1991 to 1992, she served as a law clerk to the Honorable John S. Martin of the Southern District of New York.
Ms. Neiman is admitted to practice in California, the U.S. Court of Appeals for the Federal Circuit, and before the United States Patent and Trademark Office.
Representative Matters
- JSR, Inc. v. Tokyo Ohka Kogyo, Inc. Represented the defendant in a patent infringement suit involving four patents relating to photoresist compositions. Final
judgment was entered in favor of our client after successful motions for summary judgment on the maximum damages period, invalidity,
and non-infringement.
- Bright v. Ashcroft . Represented Dan Bright, who was serving a life sentence for a murder he did not commit, in a FOIA action to obtain an unredacted
copy of an FBI document critical to his criminal appeals. After we successfully opposed the government's summary judgment
motion, the court granted Bright's FOIA request. (259 F. Supp. 2d 494; 259 F. Supp. 2d 502). According to the unredacted FBI
document, an FBI source had stated that Mr. Bright was in jail for a murder commited by someone else, and the source had heard
that person bragging about committing the murder. With the document in hand, Mr. Bright's criminal defense counsel was able
to secure his release.
- Yahoo! v. NCR . Represented Yahoo! in a declaratory judgment action against NCR involving 10 NCR patents asserted against Yahoo!. The case
settled in its early stages on confidential terms.
- Electro Scientific Industries, Inc. v. General Scanning Inc. Member of the trial team that successfully represented ESI in this patent infringement action concerning laser systems for memory repair. The jury awarded ESI in excess of $13.1 in damages. The verdict was upheld on appeal. (247 F.3d 1341).
