Bryan Wilson’s practice encompasses a wide variety of civil litigation, working with companies at all stages of maturity. In the intellectual property area, Mr. Wilson has handled many trade secrets and patent cases. He has also worked on a wide variety of securities matters, including insider trading cases, internal investigations and fraud claims. In addition handling litigation and trial matters, Mr. Wilson works closely with the firm’s corporate lawyers and clients to advise clients on how to avoid or resolve disputes without resort to litigation.
Mr. Wilson also has extensive experience in arbitration proceedings in forums including the American Arbitration Association, JAMS/Endispute and private arbitration proceedings.
For the past several years, Mr. Wilson has served as a Judge Pro Tem and arbitrator for the Santa Clara County Superior Court. He has written on a variety of topics including protective orders, recent court decisions involving trade secrets law and aspects of the attorney-client privilege.
Representative Matters
- Representative trade secrets matters include defending Restoration Hardware in a case brought by Williams-Sonoma, representing
a hardware manufacturer in a private arbitration proceeding alleging trade secrets theft, and both prosecuting and defending
companies in cases involving departing employees who were accused of misappropriating trade secrets and other proprietary
information.
- Representative recent securities matters include several internal investigations involving accounting issues and alleged corporate
misconduct, private actions by investors alleging fraud, defending a corporate officer on trial before an SEC administrative
law judge for alleged violations of accounting rules.
- Representative patent matters include defending semiconductor equipment manufacturer AST Elektronic, Inc. against infringement
claims brought by Applied Materials, defending Integratus, Inc., against infringement and other claims by Veritas, and representing
Silicon Genesis Corporation in various matters including a jury trial in which Silicon Genesis invalidated the main claims
of the patent asserted against it.
- Representative arbitration matters include a trade secret action in which our client was cleared of trade secret misappropriation,
a breach of contract action in which our client was awarded its entire demand including attorney’s fees, and the successful
defense of a recent breach of contract/fiduciary case.
- Mr. Wilson’s practice also includes a wide variety of general business litigation including writs of attachment and other provisional remedies, partnership and corporate dissolutions, and contractual disputes.
